While taking amendments to the Tax Code of Ukraine
Verkhovna Rada decided to correct the President
On the July, 7th, 2011, while taking
amendments to the Draft Law #8217 On Amendments to the Tax Code of Ukraine
and Certain Legislative Acts of Ukraine (regarding Improvement of
Certain Provisions of the Tax Code of Ukraine) in the second
reading, Verhovna Rada decided to «correct» the
President.
Based upon the text of the Draft Law
published on the website of Verkhovna Rada (the card of the draft law), the Parliament voted
for the regulations opposite to those which it voted for last
December and which were than offered by the President.
Thus, on the December, 2nd, 2010,
the President gave his opinion on the Tax Code by pointing
paragraphs which contradicted the Constitution of
Ukraine, and passed his conclusions to the Parliament in a
form of an official document: «Amendments to the Tax Code of Ukraine». In
particular, the President in his amendments pointed that the
request of taxpayer’s explanations contradicts the
Constitution.
At that time Parliament agreed with
President’s arguments, and adopted the Code as a whole
taking into account President’s amendments and
excluded the provisions on the right of tax authorities to request
explanations from the Tax Code.
And now, judging by the text from
the website of Verkhovna Rada as it was before the last voting,
Parliament returned the provision about the right to request
explanations, particularly to the article where it was removed from
by the proposition of the President (20.1.2). However even the
wording in practice is the same that was removed in December, by
proposition of the President.
In other words, the President has
been «corrected»? It's interesting, will he sign the document
if only last December he considered it unconstitutional?

Seems it is getting clear why the Vice Prime Minister Sergii
Tigipko announced different terms of official publication of the
draft Tax code.
According to information of the news agency Interfax-Ukraine the published draft Tax code was
not agreed upon with the Vice Prime Minister Sergii
Tigipko. This was announced by the deputy chairman of the
party Syl’na Ukraina Oleksandra Kuzhel.

The text of Draft Tax Code of Ukraine was published today in
Uriadovyi Kuryer # 141(4292)of 03.08.2010.
Also the text was published on the web-site of Ministry of Finance of Ukraine as wel as the
schedule of round tables on the Draft Tax
Code discussion and phones of call-centers and the
announcement of press-conference with the participation of
leaders of the Ministry of Finance of Ukraine, Ukrainian State Tax
Administration, the State Customs Service of Ukraine, the National
Academy of Sciences of Ukraine and the People´s Deputies.

When the official publishing of new draft Tax Code of Ukraine
will take place? The question is troubling Ukrainian business that
is waiting for this since July 8th, the day when the Verkhovna Rada
passed the resolution On Whole Ukrainian Discussing of the Draft Tax Code
of Ukraine. This is a state-level document, that will
determine the future of the whole Ukrainian business and, thus, to
the large extent, the future of country's economy and that
needs a serious, not fast, elaboration.
The improved draft Tax code can be published by the end of
current week. That is a forecast made by Vice Prime Minister Sergii
Tigipko, during press conference on the 2nd of August - quote
news agency Inretfax-Ukraine, news portals Ukrainska Pravda and KorrespondenT.
The forecast looks quite unclear, especially if take into
consideration that Vice Prime Minister anounced a certain date
- 2nd of August, during his working meeting with representatives of
the Federation of Employers of Ukraine, European Business
Association and PricewaterhouseCoopers, on the 23rd of July. During
the meeting there was announced that in accordance with Prime
Minister's instructions, dated 21st of July 2010, #

On the 24th of June, KM Partners law
firm together with the Institute of System Analysis of Civil
Society, held a round-table – press-conference «Anticipated
risks and adverse consequences of adoption of the new Tax
Code», the participants of the meeting were experts and
representatives of large foreign and domestic business.
The aim of the meeting was to highlight the public position that
was stated earlier, and based on the results of the analysis
and discussion with business representatives and experts.
The non-acceptance of the Tax Code in its present version and
presentation of position of the participants of the meeting are
reflected in the appeal to the President of Ukraine, Chairman of
the Verkhovna Rada and Prime Minister of Ukraine. The text of the

On Thursday, June 24th at 13:00 a round-table – press-conference
«Anticipated risks and adverse consequences of adoption of
the new Tax Code» will be held. The aim
of the meeting is to highlight the non-acceptance of the new draft
of the Tax Code by business representatives; present measures and
other steps that the representatives of business are to take. There
will be announced the generalized position of the business
representatives towards leaders of the State, and presented an
initiatives kodeksu.net, the aim of which is to discuss the Code by
business and experts. The participants of the meeting will be
experts who work with large and medium-size business, as well
as the representatives of the transnational corporations and
mass media.

Tax Code of Ukraine, based on the results of analysis of the draft
Tax Code of Ukraine #6509, dated 15.06.2010.

On the 17th of June, the Verkhovna Rada of Ukraine approved in
first reading the new Tax Code that was prepared by the Cabinet of
