KM Partners law firm accomplished the support of case
in the Higher Administrative Court of Ukraine, which by its
decision abolished the decision of the court of appeal and left in
force the decision of the court of first instance. The Higher
Administrative Court of Ukraine admitted that transfer of goods
ownership right shall not affect recognition of the services on
products’ promotion to business activity of the producer.
The case may be considered as a precedent, because this problem
affects interests of many of taxpayers, and in the above-mentioned
decision the Higher Administrative Court of Ukraine clearly
formulated its position in respect of the matter.
